• Thanks: A tough former Marine, fellow Vietnam vet, GI-bill (sort of) attorney, fellow Texan and fellow cable pioneer died a couple weeks ago ... one of those things that make one stop and think a bit.
Jerry Lindauer was one of the very good guys. Smart. Good Dad. Good citizen. One of the guys who helped build the cable industry into what has become a much, much greater player in the expanded
MVPD/communications/information/entertainment world. Just thought I should say, “Thanks.”

• Ditto?!? ... I don’t often agree with my broadcaster-centric fellow
pundit Harry Jessell, but he’s right on about Comcast at NBCU in at least this respect: “OK, no more jokes about Kabletown or the absurdity of running a major broadcast network
from some stop on the Acela between New York and Washington. ... Comcast took over NBCUniversal one year ago this Sunday, and so far has been a model owner, at least for the broadcasting end of the business that I follow.” More from Harry in his TVNewsCheck here.

• Enough-Is-Enough-Dept.: Nice to see a US Attorney agree ... the Middle District of Pennsylvania called off a languishing – for 6 years! – tax indictment against John and Timothy Rigas. Also nice to see US District Court Judge John E. Jones III agree noting, “As Kenny Rogers sang in his hit song ‘The Gambler,’ ‘You got to
know when to hold ’em, know when to fold ’em.’ Today, the Government has appropriately decided to fold ’em, and has blessedly elected to end this aspect of the unfortunate Rigas saga. It is a commendable decision.”

• My Favorite
Headline of the Week: From The Huffington Post: “President May Have To Vacate Oval Office Next Year.” Click on it for the story, though, and the headline elucidates a bit: Oval Office Renovations: White House Source Says
President May Have To Vacate Office Next Year.”

• Meanwhile, watch out, “privacy” is going to get hundreds times more complicated,
vitriolic and unsolvable.•

Pay-TV's Latino Paradox

Some estimates have pegged the collective buying power of U.S. Latinos at nearly $1 trillion. However, new research suggests that many within the Latino community are struggling financially creating ambivalence within the industry of how to capitalize on the nation's fastest growing
demographic.

According to Pew Research, 75% of U.S. Latinos say their finances are "poor" or "fair," nearly 60% say a member of their HH has been unemployed for the last year, and nearly 50% have had to cancel or delay a major purchase due to financial
constraints. The numbers are significant as financial data from the Latino community has become a critical metric to any ethnic pay-TV strategy.

It's no secret that networks like Telemundo and Univision use these
data when negotiating with advertisers. And the market is about to get even more crowded as News Corp. unveiled a partnership last week with Columbian broadcaster RCN to launch a Spanish-language competitor MundoFOX (not to mention Univision's plans for three more cable nets).

With operators increasingly looking for ways to boost revenue, the paradox becomes how to successfully deliver Spanish-language programming to a Latino market seemingly struggling with
its own financial difficulties... •

Etc.: Another DISH v. RSN Dispute - FTC Investigating Google? - Cablevision Workers Unionize

Disputes: DISH is in another RSN-related carriage dispute as its contract with Atanta-based indie station Peachtree TV (WPCH) expired without any contingency plans. The station issued a statement saying DISH "no longer has the right to carry our programming." Peachtree, owned by Turner Broadcasting, airs Atlanta Braves baseball games and SEC college sports coverage. In response, DISH said Turner is making "outrageous demands" and that the satcaster would stand pat against "unreasonable costs."

Rules & Regs: Rep. Ed Markey (D-MA) said last week he will ask the FTC to investigate whether Google's recent privacy changes violate
the company's settlement with the agency. Hillicon Valley has details. --- FT says the
battle in D.C. over spectrum enters a critical "make-or-break" week as policymakers have signaled they want to get things moving. --- AT&T filed a request
with the FCC to transfer spectrum to T-Mobile as part of the break-up fee stemming from two sides' failed merger. In related news, AT&T Chief Randall Stephenson blamed the FCC
for the company's Q4 results saying the agency is "picking winners and losers rather than letting the markets work." WSJ has
details. --- FedScoop says one of these four Feds could possibly replace Aneesh Chopra as the gov't's top CTO. --- The State of Hawaii of
considering an "unprecedented" proposal in an effort to curb online privacy: Requiring internet service providers to track every website their customers view and keep the data for two years. No
joke.

QRs: Samsung reported a 17% spike in Q4 profit Friday on the strength of flat-panel TVs and smartphones. The company posted net profits of $3.5B with a y/y operating profit
increase of 76%. --- Juniper Networks stock continued its rocky performance after the company revealed its quarterly forecast would badly miss expectations. "The disappointment continues..." says Mizuho analyst Joanna Makris. Bloomberg has more. --- WebTV network Revision3 said its viewership reached 800M last year, and advertising revenue increased 53% thanks to its distribution deals with Roku, Boxee, TiVo, Yahoo!, Google TV, Apple, Android and Microsoft's Zune. MediaBeat has more.

Strategy: Most multiplatform companies view the mobile handset as an accessory to traditional TV viewing... a third-screen. Not forward-thinkers
at ESPN, who - according to this piece from MediaPost - now see the mobile device as the first-screen... the first
option viewers have when interacting with ESPN content.

M&A: Citing people close to the matter, Bloomberg is reporting that WaveDivision
is exploring a sale that could bring in as much as $1B. "It's a buyer's market," said Bernstein's Craig Moffett. "These assets are more valuable in the hands of larger players than they are on their own."
WaveDivision serves ~325K subs in Washington, Oregon and California.

Dist.: In two separate deals, CABLEReady has acquired international distribution rights to TV Guide Network and North American distribution rights to LMNO Productions programming.

$$$: WSJ is reporting

The new 62K sq.-ft. facility has
been partially open since December with plans to fully open in June.

Mobile: Lead changes always make a good game. That's why the race toward smartphone sale supremacy is such an intriguing contest. Reports broke last week
that Apple took the lead from Nokia in June, lost its spot to Samsung in September, then won it back in December. This is getting good. CNN
Money has details.

Research: comScore says <span style="font-weight:
